Terms of use

These Terms of Use govern your access to and use of the Pythia Industries website and any account-gated areas of our platform (collectively, the “Site”). By accessing or using the Site, you agree to be bound by these terms. If you do not agree, do not use the Site.

You may use the Site for lawful, informational, and business purposes consistent with these terms. You agree not to: (a) access or use the Site in violation of any law; (b) attempt to probe, scan, or test the vulnerability of the Site or breach its security or authentication measures; (c) interfere with or disrupt the Site or the servers and networks supporting it; (d) use automated means to harvest content or data from the Site; (e) reverse engineer, decompile, or otherwise attempt to derive source code from any portion of the Site; or (f) use the Site to develop a competing product or service.

Certain areas of the Site are gated and require authorized access. You are responsible for maintaining the confidentiality of any credentials issued to you, for all activity that occurs under your access, and for notifying us promptly of any unauthorized use. We may suspend or revoke access at any time, with or without notice, where we believe doing so is necessary to protect the Site, our clients, or third parties.

Nothing on the Site constitutes an offer to enter into a paid engagement, a binding commitment, or the creation of a client relationship. Engagements are governed exclusively by an executed engagement letter and any associated non-disclosure agreement. Conflicts between these terms and an executed engagement letter are resolved in favor of the engagement letter.

The sample report and any other illustrative materials made available on the Site use synthetic or anonymized data and do not represent any actual client. Real deliverables are confidential to our clients and are never published.

The Site, including its design, code, text, graphics, the Factory Fingerprint schema, the underlying corpus, and all other content published on it, is owned by Pythia Industries or its licensors and is protected by intellectual property laws. Except for the limited right to view and use the Site for its intended purpose, no rights are granted to you, whether by implication, estoppel, or otherwise.

If you submit content to the Site, including notes, chat messages, or other input within the platform, you grant Pythia Industries a worldwide, non-exclusive, royalty-free license to use that content for the purpose of operating and improving the Site and providing services to you or your organization. You represent that you have the rights necessary to grant this license and that your submissions do not infringe any third-party rights or violate any law.

Information shared with us during an engagement is governed by the non-disclosure agreement and engagement letter for that engagement. Nothing on the Site modifies those obligations.

Content on the Site is provided for general informational purposes and does not constitute investment, financial, legal, tax, accounting, or other professional advice. You should not rely on Site content as a substitute for advice from a qualified professional familiar with your specific situation.

The Site may link to, embed, or otherwise interoperate with services operated by third parties. We do not control those services and are not responsible for their content, availability, or practices. Your use of any third-party service is governed by that provider’s own terms.

The Site is provided on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, Pythia Industries disclaims all warranties, whether express, implied, statutory, or otherwise, including any warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade. We do not warrant that the Site will be uninterrupted, error-free, secure, or that any defects will be corrected.

To the fullest extent permitted by applicable law, Pythia Industries, its affiliates, and its personnel will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or related to your use of the Site, even if advised of the possibility of such damages. Our aggregate liability arising out of or related to the Site will not exceed one hundred U.S. dollars ($100). Some jurisdictions do not allow the exclusion or limitation of certain damages, so these limitations may not apply to you in full.

You agree to indemnify, defend, and hold harmless Pythia Industries, its affiliates, and its personnel from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to your use of the Site, your submissions, or your violation of these terms or any applicable law.

We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including any suspected violation of these terms. Provisions that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, indemnification, and the dispute resolution provisions.

For users acting in connection with an executed engagement letter, the governing law and dispute resolution forum specified in that engagement letter will control. For all other use of the Site, disputes will be resolved under the laws and in the courts of the jurisdiction in which Pythia Industries is then established, without regard to conflict-of-laws principles, and subject to any non-waivable consumer protection rights of your place of residence.

If any provision of these terms is held to be unenforceable, the remaining provisions will remain in full force and effect. These terms, together with any executed engagement letter and any policies referenced on the Site, constitute the entire agreement between you and Pythia Industries with respect to the Site. You may not assign these terms without our prior written consent. We may assign these terms in connection with a corporate transaction. Our failure to enforce any provision is not a waiver of that provision.

We may update these terms from time to time. When we do, we will revise the “last updated” date above. Continued use of the Site after a change constitutes acceptance of the revised terms.
